The present Terms and Conditions are the basis of a contract between SAILOR SUIT Yachting Academy and our students.

1. Overview
The present Terms and Conditions are the basis of a contract between Salparo GmbH, registered office at Arenenbergstrasse 2, 8268, Salenstein, Switzerland, and the customer.
“SAILOR SUIT” is the trade name of Salparo GmbH, for the purposes of the RYA training centre of Salparo GmbH
The following terminology applies to these Terms and Conditions and all Agreements:
“Offer”, “Agreement”, “Booking Agreement” refers to the official contract between Salparo GmbH and the customer.
“Customer”, “Student” “You” and “Your” refer to all the persons included in the booking contract.
“SAILOR SUIT”, “The School”, “Ourselves”, “We”, “Our” and “Us”, refer to Salparo GmbH.
“Instructor” and “Skipper” refer to employees of the company Salparo GmbH, or freelance contractors, in contract with Salparo GmbH.
“Yacht” refers to the vessel of the contract.
“Course” means the tuition and associated facilities provided by us to teach you elements of navigation, seamanship, powerboating and sail cruising.
“Event” and “Activity” refer to additional services offered by Salparo GmbH, other than courses
The instructor or skipper in charge of a course/event/activity is entitled to act on behalf of Salparo GmbH.
2. Booking process
2.1. Booking directly with SAILOR SUIT
The process of booking directly with SAILOR SUIT is considered valid only with the use of the offer issued by SAILOR SUIT. Every offer bears a unique reference number. With any payment using the respective reference number, the offer is considered as the booking agreement and the customer agrees to the Terms and Conditions of SAILOR SUIT.
2.2. Booking through a 3rd party
Booking through a 3rd party provider (e.g. an agent). The customer agrees to the Terms and Conditions of SAILOR SUIT. In case of overlapping, the Terms and Conditions of SAILOR SUIT apply over those of the 3rd party provider.
3. Payments
In order to secure the booking a down payment of 20% of the total price is required within 7 days. A second 20% instalment of the down payment is required within 30 days from the payment of the first instalment. Failure in timely payment of the second instalment is considered a cancellation by the customer.
Full payment up to 30 days before departure is required. Delayed full payment is considered automatically as a cancellation by the customer.
SAILOR SUIT reserves the right to offer its customer(s) special payment terms. Such terms when included in the booking agreement apply over the terms of this paragraph, “Payments”.
All payments and refunds do not contain any interest.
All payments shall be made by bank wire transfer. For all bank transfers, the reference number of the corresponding booking agreement is required. All bank transfers must be made to the valid bank accounts of Salparo GmbH. For any bank transfer, the customer takes full responsibility for conducting payments only to the following valid bank accounts of Salparo GmbH:

4. Extra costs
Any additional costs, beyond the ones included in the booking contract, such as extra activities, alimentation ashore and other personal expenses of the customer, must be covered by the customer.
5. Cancellation Policy
In case of mutual agreement to postpone a course/event/activity, no cancellation fees are charged.
5.1. Cancellation by the customer
In the event of cancellation of the practical course/event/activity by the customer, for any reason, the following cancellation policy will apply:
For cancellation announced 1 to 30 days prior to the start of the practical course/event/activity, the total price is due.
For cancellation announced 31 or more days prior to the departure, 40% of the total price is due.
Should the customer not appear on the commencement date and time of the practical course/event/activity, without previous notice, the booking agreement is considered as cancelled by the customer and the total amount is due. In case the customer appears delayed, after previous notice, the participation of the customer at the course/event/activity is at the sole discretion of SAILOR SUIT.
5.2. Cancellation by SAILOR SUIT
In the event of cancellation of the course/event/activity by SAILOR SUIT, we offer the customer two options:
- A replacement course/event/activity. No administration fees will be charged to the customer.
- Refund of the total amount paid to SAILOR SUIT till the time of the cancellation announcement.
5.3. Force Majeure
In the event of cancellation of the course/event/activity, due to force majeure, the customer will receive a voucher in the value of 50% of the total amount paid till that time, in order to use it for a future booking with SAILOR SUIT.
SAILOR SUIT reserves the right to interrupt or terminate the course/event/activity, without any refund, if Force Majeure circumstances arise.
6. Amendments
6.1. Amendments by the customer
Amendments to any of the parameters of the contract that customers may wish to make are subject to SAILOR SUIT being able to make and cater for. All changes will be subject to availability and will be made at SAILOR SUIT’s discretion.
Customers must notify SAILOR SUIT in writing of any wish for changes to a confirmed contract.
The charge of administration fees for changes is at SAILOR SUIT’s discretion. The customer will be informed about any fees and any change to the contract must be mutually agreed upon before it will be considered confirmed.
6.2. Amendments by SAILOR SUIT
SAILOR SUIT reserves the right to replace the vessel and/or the instructor/skipper of the course/event/activity, at any time, without prior notice, without any price changes, and without any refund.
We also reserve the right to refuse an RYA course completion certificate, if the required tuition times are not met.
7. Variations during the course/event/activity
In the event of course interruption, or early termination, due to physical limitations of the instructor, or due to technical issues and damages to the vessel, the customer will receive a voucher to repeat the full course at another time in the future.
SAILOR SUIT reserves the right to replace the instructor/skipper or/and the sailing vessel at any time during the course/event/activity, without prior notice.
8. Travel documents
You are responsible for obtaining and possessing all entrance and exit, health, and other documentation required by laws, regulations, orders, demands, or requirements of Hellenic Republic, as well as having them ready for presentation as needed. We reserve the right to refuse to provide a course to anybody who has not cooperated with the applicable laws, regulations, orders, demands, or requirements, or whose documents do not appear to conform with them.
A passenger list (with personal data such as name, passport number, date of birth, etc.) should be submitted prior to the course/event/activity. All passengers are obliged, for the entire duration of the course/event/activity, to carry a valid ID or passport.
All passengers must fill out the respective form, which SAILOR SUIT will provide them with, 30 days prior to the departure date.
9. Personal Liability / Injury and death
The customer should take full responsibility for any medical ailments, physical limitations, or mental disabilities that will affect their ability to participate in the course/event/activity. SAILOR SUIT undertakes no legal or financial responsibility for any implication related to these issues.
We would like to remind you that sailing is a potentially dangerous activity, and we cannot be held liable for any injuries or deaths that occur during one of our courses, with the exception of our obligations under the Merchant Shipping Act 1975 and the findings of any official enquiry held under the requirements of the same act.
10. Right to use photos and videos
SAILOR SUIT uses the images of real people during their course/event/activities on SAILOR SUIT advertising materials, promotional materials and general publicity. If a crew member or a photographer is taking photographs or video, and you have an objection to these being used by SAILOR SUIT in an aforementioned manner, please make your objection known at the time.
11. GDPR / Personal data that we collect:
11.1 Contact details
This information will be used to confirm your booking and send out necessary information about your course/event/activity. Upon successful completion of your Day Skipper or Coastal Skipper course; your name, contact information, date of birth, certificate number and issue date will be shared with the RYA through a secure web portal on www.rya.org.uk. This data will be stored on the RYA’s central database. This information allows the RYA to document your qualification, to update any records they may hold for you, and to verify or replace your certificate if required. For further information on how the RYA will deal with your data, please see the RYA’s privacy policy at www.rya.org.uk/go/privacy.
On successful completion of all other courses, your name, certificate number and date of issue will be stored for up to 7 years. This information allows us to verify the integrity of your certificate and replace it if required.
11.2. Student Records
SAILOR SUIT will document your training to include name, contact information, certificate number, date and course result, instructor, ports visited and mileage. If you are not in favour of your details being stored, then you may request for them to be deleted. However, neither the centre nor the RYA will be able to replace or verify your certificate in the future should this request be made.
We will retain the personal data you provide for administrative purposes of (including certificate replacement or advice about continuing your training). You can request the removal of your contact information at any given time. SRC exam papers will be stored for up to 5 years in accordance with RYA requirements.
11.3. Feedback
We will also send a message to you as to ask for your feedback. This is required by the RYA and helps us improve our services to you and others. We might pass on your feedback to your instructor or skipper and the rest of the team. This is a great way of passing on praise, share your feedback and remarks on the experience. In these cases, we are careful with how this information is shared and of course you can always leave your feedback anonymously. The RYA may contact students if necessary for quality assurance of RYA training or for instance in the investigation of a complaint or incident. In these situations, the information is used only for the requested purpose and is not processed in the RYA central database.
Your feedback is collected by secure providers and a request will be sent to your personal email after the end of the course.
11.4 Special Requirements
You will have the chance to inform us about any special requirements you may have, such as a precarious medical condition, mobility issues or educational special needs. You can inform us about them when you make your booking, and they will be kept alongside your contact information. You will also have the choice to provide us with this information when you arrive, and they will be deleted one year after the course is completed. Do not refrain from informing us about them at your earliest behest in order to plan your training and tailor it around your needs.
12. Passing or failing course
You will be assessed by an Instructor and/or Examiner/Assessor during the course. At the end of the course, they will decide if you have passed or failed. Their decision is final. If, however, you disagree with their decision, you should make an official complaint to the school. If after the previous action, you still feel you were treated unfairly, you may make an application to the Royal Yachting Association for redress in the form required by our organisation.
13. Complaints
Should you have a complaint about any aspect of our course/event/activity or service, please make it known to your Instructor/skipper at the time.
If you are still dissatisfied, please let us know in writing on the Feedback/Complaints Form that you will be given at the end of the course/event/activity.
We take the quality of our service seriously and will do what we can to remedy the situation.
14. Weather Conditions
Should the weather not permit departure, as this is subject to the instructor’s/skipper’s judgment, no refunds are subjected to any delays or plan changes.
15. Newsletter
SAILOR SUIT may send to its customers an email series with information and articles about sailing courses/events/activities, sailing experiences, promotions, discounts and other SAILOR SUIT offers. Customers can exclude themselves from receiving this email by clicking on the corresponding link at the bottom of the email.
